The legal basis for data processing are legal obligations resulting from tax regulations (Tax Legislation, Value Added Tax Act, Corporate Income Tax Act) and accounting regulations (Accounting Act), discharge of obligations as an Obligated Entity under the AML Act;
  3. Legitimate interests of PKN ORLEN S.A. (Article 6(1)(f) of the GDPR), i.e. handling, exercise and defence mutual claims, if any.

IV. DATA RECIPIENTS

PKN ORLEN S.A. may disclose your personal data to entities cooperating with PKN ORLEN S.A. (data recipients), in particular to entities providing services consisting in invoicing, settlement of receivables, delivery of letters and packages, as well as OHS, legal, debt collection and archiving services.

V. RETENTION OF PERSONAL DATA

We store your personal data for the following periods:

  • the duration of the contract,
  • until the expiry of data processing obligations arising under applicable laws,
  • until the expiry of mutual claims under the contract.

VI. YOUR RIGHTS

You have the following rights related to the processing of your personal data:

  • the right to access your data,
  • the right to have your personal data rectified,
  • the right to have your personal data erased or to restrict its processing,

  • Ten (10) years from the last activity registered in the access control system in the case of personal data processing related to movement of people;
  • For the period specified in the “PKN ORLEN S.A. Materials Movement Instruction” in the case of personal data processing related to movement of materials.

You have the right to access your personal data, to have the data rectified (e.g. where it is incorrect or incomplete) or erased or have its processing restricted, as well as the right to object to the processing of the data and the right to transfer the data to another controller.

Video surveillance recordings are processed on the basis of PKN ORLEN S.A.’s legitimate interests (in accordance with Article 6(1)(f) of the GDPR), understood by PKN ORLEN S.A. in particular as the need to ensure the safety of people and property as well as potential exercise or defence of claims.

IV. DATA RECIPIENTS

Video surveillance recordings may, in justified cases, be made available to law enforcement authorities upon their request.

Recordings from video surveillance systems may also be transferred by PKN ORLEN S.A. to entities cooperating with it (data recipients) on the basis of personal data processing agreements, in particular to entities responsible for supervising the operation of video surveillance systems, including for their maintenance.

V. RETENTION OF PERSONAL DATA

Video surveillance recordings will be stored for up to three (3) months, unless they have been secured as part of a law enforcement investigation. In such cases, the recordings are stored until the case is finally closed.

VI. YOUR RIGHTS

You have the right to access your data, have it rectified or erased, or to restrict its processing. At the request of a data subject, PKN ORLEN S.A. will provide a copy of personal data subject to processing, provided that the provision does not adversely affect the rights and freedoms of other persons.
