PKN ORLEN application to set aside the Court of Arbitration Award with respect to the PKN ORLEN Statement of Claim against Yukos International in connection with transaction of purchase of AB Mazeikiu Nafta shares.

Polski Koncern Naftowy ORLEN Spolka Akcyjna ("PKN ORLEN") hereby informs that on 28 May 2013 it submitted an application with the High Court of Justice, Queen’s Bench Division, Commercial Court in London to set aside the award issued by the Court of Arbitration at the International Chamber of Commerce in Paris on 15 April 2013 with respect to the Statement of Claim lodged by PKN ORLEN against Yukos International UK B.V. headquartered in the Netherlands  (“Yukos International”)  and delivered to PKN ORLEN on 29 April 2013 (the “Award”).

The Statement of Claim lodged by PKN ORLEN against Yukos International related to payment by Yukos International to PKN ORLEN of USD 250 m with interest and costs of proceedings. The amount sought by PKN ORLEN in the arbitration proceedings of USD 250 m was deposited in the escrow account as part of payment for AB Mazeikiu Nafta (currently: AB ORLEN Lietuva) shares, to secure potential claims of PKN ORLEN against Yukos International for inconsistency with the actual state of affairs pertaining to Yukos International regarding the condition of AB Mazeikiu Nafta as at 14 December 2006.

In the Award the Court of Arbitration dismissed entirely claims of PKN ORLEN and obliged PKN ORLEN to cover costs of proceedings incurred by Yukos International.

PKN ORLEN owns 100% of AB ORLEN Lietuva shares.
