PGNiG: The Supreme Court issues a ruling on the appeal against the decision of the President of the Energy Regulatory Office
The Management Board of Polskie Górnictwo Naftowe i Gazownictwo S.A. (“PGNiG”, “Company”) announces that on April 21nd 2016, the Supreme Court considered the Company’s cassation appeal and issued a ruling concerning a PLN 2,000,000 fine (finally reduced by the Court of Appeals to PLN 500,000) imposed on PGNiG S.A. by the President of the Energy Regulatory Office for an alleged breach of the terms of the licence to trade in natural gas with foreign partners in 2007 and 2008, by exceeding the maximum share of gas imported from a single country in total gas imports in each of the two years.
The Supreme Court reversed the Court of Appeal’s decision of January 14th 2015 and changed the preceding ruling of the Competition and Consumer Protection Court at the Regional Court of Warsaw, dated October 10th 2013, by amending the decision of the President of the Energy Regulatory Office so that according to its new wording PGNiG has not breached the terms of the licence.
