ING OFE go over 5% in PKN ORLEN

Polski Koncern Naftowy ORLEN S.A. ("PKN ORLEN") hereby announces that on 20 February 2009 it received a notice that ING Otwarty Fundusz Emerytalny („Fund”), through the purchase of PKN ORLEN shares in transactions on the Warsaw Stack Exchange, settled on 18 February 2009, became a holder of PKN ORLEN shares representing over 5% of the total votes at the PKN ORLEN General Meeting of Shareholders.

Before the purchase of PKN ORLEN shares, the Fund held 21 373 541 of PKN ORLEN shares representing 4,997% of registered capital of PKN ORLEN, with 21 373 541 of votes at the PKN ORLEN General Meeting attached to these shares, representing 4,997% of the total votes.

As on 20 February 2009 the Fund holds 22 118 813 PKN ORLEN shares, representing 5,17% of registered capital of PKN ORLEN. The shares of PKN ORLEN, which are owned by Fund, entitle to 22 118 813 votes on PKN ORLEN General Meeting, representing 5,17% of the total votes.
